Authored by our Business Advisory and Foreign Investment team, this article examines the legal framework governing the enforceability of “no refund” policies in Nigeria, with a focus on the Federal Competition and Consumer Protection Act 2018 and the Sale of Goods Act 1893.
In this piece, we analyse the extent to which businesses may rely on contractual freedom to restrict refund rights, and the statutory limitations imposed on such practices. The article also considers consumer rights in relation to defective or non-conforming goods and services, relevant judicial authorities, and provides guidance on structuring refund and return policies in compliance with applicable law.
